Acceptance
By installing or using the CUST/OS plugin, or by accessing this website, you agree to these Terms of Service. If you do not agree, do not install or use the plugin.
The plugin
CUST/OS is an ATAK plugin provided by NimbusXR. It is currently in beta. Features may change, break, or be removed without notice during the beta period.
License
Subject to these terms, NimbusXR grants you a non-exclusive, non-transferable, revocable license to install and use the plugin on devices you own or control. This license does not grant you rights to reverse-engineer, redistribute, or sublicense the plugin binary except as expressly permitted by applicable law.
The optional starter skill kit published at github.com/nimbusxr/custos is distributed separately under the MIT License. Those terms govern the starter kit.
Operator responsibility
CUST/OS routes inference requests and executes operator-authored Lua skills inside a sandbox. The operator is responsible for:
- Configuring inference providers, classification levels, approval gates, and security modes appropriate to the mission and the data handled.
- Reviewing and approving the output of any skill before acting on it. The plugin's approval gates help but do not eliminate operator responsibility.
- Installing only Lua skills from trusted sources. Skills execute with sandbox restrictions but may still interact with the ATAK environment.
- Complying with all laws, regulations, and orders applicable to the operator.
Prohibited conduct
You may not use CUST/OS to:
- Violate any law, regulation, or order.
- Infringe third-party rights, including intellectual property and privacy rights.
- Interfere with or disrupt the integrity of the plugin, ATAK, or networked systems.
- Circumvent the plugin's approval gates, audit logging, or classification boundaries.
Third-party services
CUST/OS can route requests to third-party inference, embedding, speech, or vision providers at the operator's configuration. Your use of those providers is governed by the provider's own terms and privacy policies. NimbusXR is not a party to your relationship with third-party providers and is not responsible for their conduct or availability.
No warranty
CUST/OS is provided "as is" and "as available", without warranty of any kind — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, and non-infringement. The plugin is beta software and may contain defects. Do not rely on it as the sole basis for any operational decision with safety-of-life, safety-of-mission, or legal consequences.
Limitation of liability
To the maximum extent permitted by law, NimbusXR will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of CUST/OS, even if NimbusXR has been advised of the possibility of such damages. NimbusXR's total cumulative liability under these terms will not exceed the greater of US $100 or the amount you paid NimbusXR (if any) for the plugin in the twelve months before the event giving rise to the liability.
Indemnification
You agree to defend, indemnify, and hold harmless NimbusXR and its officers, employees, and contractors from and against any claims, damages, liabilities, and expenses arising out of your use of the plugin, your breach of these terms, or your violation of applicable law.
Changes
NimbusXR may update these terms from time to time. The effective date above indicates when the current version took effect. Continued use of CUST/OS after an update constitutes acceptance of the updated terms.
Termination
You may terminate your use of CUST/OS at any time by uninstalling the plugin. NimbusXR may suspend or terminate your license if you breach these terms.
Governing law
These terms are governed by the laws of the jurisdiction in which NimbusXR is principally located, without regard to conflict-of-laws principles. Venue for any dispute is the state and federal courts of that jurisdiction.
