End-User License Agreement

Parties

This End-User License Agreement (the "Agreement") is between NimbusXR (the "Licensor") and you (the "Licensee"). By installing, copying, or otherwise using the CUST/OS plugin binary (the "Software"), you agree to be bound by this Agreement.

Grant of license

Licensor grants Licensee a non-exclusive, non-transferable, revocable license to install and use the Software on devices Licensee owns or controls, solely for Licensee's own use with a valid installation of ATAK, subject to this Agreement.

Restrictions

Licensee may not:

  • Reverse-engineer, decompile, or disassemble the Software, except to the extent applicable law permits.
  • Distribute, sell, sublicense, rent, lease, or host the Software for others.
  • Remove or alter proprietary notices in the Software.
  • Use the Software to develop a competing product.

The open-source starter skill kit published at github.com/nimbusxr/custos is not governed by this Agreement; that repository's MIT License applies.

Ownership

Licensor retains all right, title, and interest in and to the Software, including all intellectual property rights. This Agreement does not transfer ownership of the Software.

Updates

Licensor may make updates available. Updates may add, change, or remove features, and may be required for continued operation. Updates are governed by this Agreement unless an update is accompanied by its own license, in which case that license governs.

No warranty

The Software is provided "as is" without warranty of any kind. Licensor disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent permitted by law, Licensor will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. Licensor's total liability under this Agreement will not exceed US $100.

Termination

This Agreement terminates immediately if Licensee breaches any term. Licensee may terminate by uninstalling the Software. On termination, Licensee must cease all use of the Software.

Governing law

This Agreement is governed by the laws of the jurisdiction in which Licensor is principally located, without regard to conflict-of-laws principles.
